Do it Right the First Time
It's important to note that mistakes can delay or even disqualify a Pre - Migration Skills Suitability Assessment Application to visa filing. Unlike appealing to the Courts to correct a decision by the Department of Immigration (DIAC known as DIMIA pre 02/2007), no Independent right of review exists for affected Skill Assessing Authority outcomes.
In today's ever-changing, increasingly unpredictable immigration landscape, it's more important than ever to get a case done right the first time -- it's crucial to make a correct, thorough application the first time, with accurate forms, visa category and supporting documents.
One of our clients, M. Khan, discovered the importance of correctly submitting the Visa application. To complete his paperwork, he used another legal firm. Expecting success, Mr. Khan was horrified to hear that his application was refused and that he should withdraw his case.
Here's what he has to say...
"I also regret working with my previous lawyer who was very un-professional and made my whole application a mess. To start off, I was never given right advice and was confused from day one whether my application was heading the right direction. After completion of my post graduate course in Melbourne in Business IT, I was very sure that I was eligible to get my PR. My previous lawyer did promise me success, but I was rejected and my previous lawyer told me to only withdraw the case, and he could not help me for the appeal against the DIMA. It's then I was asked to approach you by my good friend Mr. Harsha and I feel it was the right move I took and regret why I never used your service from day one. You have been simply great and your service cannot be compared to none of the lawyers I had approached for my DIMA appeal. You convinced me to file against DIMA even though I was only in touch with you by email from INDIA. ... I am glad to know that DIMA agreed to their mistake done on my application and they reverted their decision." |
As you've just read, an important step in any successful visa application is to make sure it's done correctly.
There are many ways to innocently sabotage your application. One common mistake is selecting an inappropriate skilled occupation. You must be careful when selecting an appropriate skilled occupation. The Pass Mark and Skilled Occupations List are subject to frequent change and may adjust between time of application and decision.
The recent "Employment Experience" factor is also technical in nature often requiring an applicant to have worked in a closely related occupation to that nominated or relying on another occupation unrelated and on the Skilled Occupations List.
