Spouse / Interdependency applicants

June 1, 1999

Amendments made to the following permanent Spouse and Interdependency visa subclasses:

  • Subclass 100 (Spouse)
  • Subclass 110 (Interdependency)

 The amendments affect applicants for the following permanent visas:

  • Spouse (Migrant)(Class BC); or
  • Interdependency (Migrant)(Class BI)

whose applications were refused, and whose temporary visa:

  • Subclass 309 (Spouse (Provisional)); or
  • Subclass 310 (Interdependency (Provisional))

(as applicable) ceased on notification of the initial refusal.

 Where the refusal decision is later overturned (following successful review by the Migration Review Tribunal (’MRT’) or a successful decision following remittal by the MRT), these persons may now satisfy criteria for grant of the permanent visa (Subclass 100 or 110 as applicable), despite the fact that they no longer hold the relevant temporary visa.
